1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Tribunal OS ("Platform," "we," "us," or "our"), governing your access to and use of the Tribunal OS platform accessible at tribunaliq.org, including all associated services, features, content, and applications (collectively, the "Services").
By accessing, registering for, or using the Services, you represent and warrant that you have the legal capacity to enter into these Terms and that you agree to be bound by them in their entirety. If you are accessing the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, you must immediately discontinue all use of the Services.
2. Eligibility
The Services are intended for use by legal professionals, investigators, researchers, prosecutors, and institutional partners engaged in war crimes investigation and international justice efforts. To use the Services, you must:
- Be at least sixteen (16) years of age, or the age of legal majority in your jurisdiction, whichever is greater
- Have the legal capacity to enter into binding agreements
- Not be prohibited from accessing the Services under applicable law
- Provide accurate and complete registration information
3. Account Registration and Security
Access to certain features of the Services requires account registration through our OAuth-based authentication system. When you register, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security and confidentiality of your authentication credentials
- Immediately notify us of any unauthorized access to or use of your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised, are being used in violation of these Terms, or pose a security risk to the Platform or other Users.
4. Description of Services
Tribunal OS provides an AI-powered platform for war crimes investigation and prosecution support. The Services include, but are not limited to:
- AI-Powered Analysis Services: Over 200 specialized AI services across ten categories, including evidentiary forensics, survivor and witness narrative analytics, jurisdictional and legal data mining, predictive legal analytics, compliance and ethical auditing, global collaboration and legal strategy, real-time courtroom support, post-trial analysis, financial forensics, and geospatial, temporal, and network analysis.
- Case Management: Tools for creating, organizing, and managing investigation cases, including evidence storage, notes, timelines, and service execution tracking.
- Evidence Management: Secure upload, storage, and retrieval of evidentiary materials through cloud storage infrastructure.
- Deep Analysis (MPPT): Advanced analytical processing including multi-branch analysis, decision agent interactions, quantum rankings, and scenario evaluation.
- Batch Processing: Capability to execute multiple AI services sequentially against case data.
- Workflow Templates: Pre-configured investigation workflows for common prosecution scenarios.
- Reporting: Generation of analytical reports and case documentation.
5. Acceptable Use Policy
You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Services for any purpose that violates applicable local, national, or international law or regulation
- Upload, transmit, or store any content that is unlawful, defamatory, obscene, or that infringes the intellectual property rights of any third party
- Attempt to gain unauthorized access to any portion of the Services, other accounts, computer systems, or networks connected to the Services
- Use automated scripts, bots, scrapers, or similar tools to access or extract data from the Services without express written authorization
- Interfere with or disrupt the integrity or performance of the Services or the data contained therein
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software component of the Services
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
- Use the Services to fabricate, falsify, or misrepresent evidence or analytical outputs
- Circumvent, disable, or interfere with security-related features of the Services
- Use AI-generated outputs from the Services as sole, uncorroborated evidence in legal proceedings without independent verification
- Share account credentials or provide access to unauthorized individuals
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account and access to the Services, without prior notice or liability.
6. Intellectual Property Rights
6.1 Platform Ownership
The Services, including all software, algorithms, AI models, user interfaces, designs, text, graphics, logos, and documentation, are owned by or licensed to Tribunal OS and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Services except for the limited license to use the Services as expressly permitted herein.
6.2 User Content
You retain all ownership rights in the data, evidence, case materials, and other content you upload to or create through the Services ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, non-transferable license to process, store, and display your User Content solely for the purpose of providing the Services to you.
6.3 AI-Generated Outputs
Analytical outputs, reports, and results generated by the AI Services based on your User Content ("Outputs") are provided to you for your use in connection with your investigation and legal activities. We do not claim ownership of Outputs generated from your User Content. However, we retain all rights in the underlying AI models, algorithms, and methodologies used to generate such Outputs.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY AI-GENERATED OUTPUTS, ANALYSES, OR RECOMMENDATIONS
- WARRANTIES THAT THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS
AI-generated outputs are computational analyses and do not constitute legal advice, expert testimony, or definitive factual determinations. All outputs should be independently verified by qualified professionals before being relied upon in legal proceedings or decision-making processes. We do not guarantee the admissibility of any output in any court or tribunal.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- IN NO EVENT SHALL TRIBUNAL OS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.
- OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US FOR USE OF THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
- WE SHALL NOT BE LIABLE FOR ANY DECISIONS MADE OR ACTIONS TAKEN BASED ON AI-GENERATED OUTPUTS, ANALYSES, OR RECOMMENDATIONS PROVIDED THROUGH THE SERVICES.
- WE SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT RESULTING FROM YOUR FAILURE TO MAINTAIN THE SECURITY OF YOUR AUTHENTICATION CREDENTIALS.
THE LIMITATIONS SET FORTH IN THIS SECTION SHALL APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless Tribunal OS and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of or access to the Services
- Your violation of these Terms or any applicable law or regulation
- Your User Content or any content you submit, post, or transmit through the Services
- Your infringement of any intellectual property or other rights of any third party
- Any claim that your use of AI-generated outputs caused damage to a third party
10. Termination
We reserve the right to suspend or terminate your access to the Services, in whole or in part, at any time and for any reason, including but not limited to violation of these Terms, suspected fraudulent or abusive activity, or extended periods of inactivity. We will make reasonable efforts to provide notice prior to termination, except where immediate action is necessary to protect the Platform, other Users, or comply with legal obligations.
Upon termination, your right to access the Services ceases immediately. We will retain your data in accordance with our Privacy Policy and applicable legal retention requirements. You may request export of your User Content prior to account closure by contacting us through our Contact page.
The following sections survive termination: Intellectual Property Rights, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, and any other provisions that by their nature should survive.
11. Third-Party Services
The Services may integrate with or contain links to third-party services, websites, or resources. We do not control, endorse, or assume responsibility for any third-party services. Your use of third-party services is governed by their respective terms and policies. We shall not be liable for any loss or damage arising from your use of or reliance on any third-party service.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date and provide notice through the Platform. Your continued use of the Services after the effective date of any modification constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Services.
13. Modifications to Services
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tribunal OS maintains its principal place of operations, without regard to conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall first be submitted to good-faith negotiation between the parties for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration administered by a recognized arbitration institution, conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
15. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, Data Processing Agreement, and Accessibility Statement, constitute the entire agreement between you and Tribunal OS regarding the Services and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
